Terms Of Use
The use of this site is governed by, among other things, the policies, terms and
conditions set forth below. Please read them carefully. You indicate that
you accept these terms and conditions by doing any one or more of the following:
1) using this site; 2) placement of an order and/or 3) downloading a trial version.
These terms and conditions
shall supercede any subsequent terms or conditions. Nobex
Technologies (Nobex) reserves the right to make changes to this site and these
terms and conditions at any time. The use of the Nobex Contacts for Microsoft® Outlook®
product is governed by the license agreement included in its setup procedure.
Limitation of Liability. Nobex's total liability,
whether for breach of contract, warranty, negligence, strict liability in tort or
otherwise, is limited to the price of the particular products sold under these Terms
with respect to which losses or damages are claimed. In no event will Nobex be liable for any loss of use, loss of time, inconvenience, commercial
loss, lost profits or savings or other incidental or consequential damages to the
full extent such may be disclaimed by law. No action will be brought for any breach
of these Terms more than one year after the accrual of such cause of action. You
agree that this limitation of liability is comprehensive and applies to all damages
of any kind, including without limitation direct, indirect, compensatory, special,
incidental, punitive and consequential damages. Some states do not allow the exclusion
or limitation of incidental or consequential damages, so the above limitation or
exclusion may not apply to Buyer.
Return Policy. Customers of Nobex wishing to return a downloaded software
product within 30 days of purchase must send an email request to billing@nobexcontacts.com. The
buyer must include first name, last name, and email address, in the request. To obtain
a replacement or a refund of a defective downloadable product within 30 days of
download, the buyer must submit a written request via email as specified
above. Once Nobex has received and processed the buyer's request, a refund
confirmation will be sent by e-mail.
Each user is fully responsible for paying all monies owed to Nobex. In respect
of any payment made by you, you agree that you will not make any charge-backs, and/or
deny or reverse any such payment and will reimburse Nobex for any charge-backs,
denial or reversal of payments you make and any expense incurred or loss suffered
by Nobex as a consequence. Nobex may, at its sole discretion, cease
to provide the service and/or demand payment as aforesaid from any such user.
